Section 1: What information do you collect on your website or though your products?

We collect two types of information: personally identifiable information and non-personally identifiable information.

Personally Identifiable Information
Personally Identifiable Information or PII is Information that can be traced back to an individual.  Examples of PII may include your name, date of birth, home address, telephone number, email address, billing and credit card information.  The only Personally Identifiable Information that we collect from you is information that you voluntarily submit to us.  We may collect this information in four ways: 1) when you sign up for our Newsletter or share our content with a friend, 2) when you sign up for one of our online products and/or update your member profile/account information, 3) when you send photos or emails to your Nutrax inbox, or 4) in connection with other products, services, or promotions we may offer on our website from time to time.  But in all cases, unless you give us permission to do so, we will never sell, share, license, trade or rent your Personally Identifiable Information other than as specified in this Privacy Policy.

You are not obligated to submit any Personally Identifiable Information.  However, if you choose not to submit any Personally Identifiable Information, you will not be able to sign up for any of our online products and you may not be able to enjoy all of our non-subscription products, services, or promotions we may offer now or in the future.  We will not request Personally Identifiable Information, your user name and/or password nor credit card information via email.  In the event that you receive any communication that purports to be from Nutrax seeking Personally Identifiable Information, send that request to Nutrax via email to privacy@nutraxcorp.com or you may fax it to 1 (360) 285-8350 or by mail to the address stated below.

Non-Personally Identifiable Information
Non-Personally Identifiable Information is Information that by itself can not be traced back to an individual.  Examples of non-personally identifiable information may include demographic information (age, gender, ethnicity, etc…), health information (height, weight, diseases, etc…), IP addresses, browser types, domain names, or other anonymous statistical data related to website usage.

Information Collection

We may collect your information in different ways and at different time as you visit our website or as you use our online products.  Below you will find more detail on how and when we collect this information.  Again, we only collect Personally Identifiable Information when you voluntarily submit it to us.

When visiting our website we may collect information about you in the following ways:

1.       If you sign up for our Newsletter, we may require you to provide us with information (including Personally Identifiable Information) such as your name and your email address.  This information is necessary for us to deliver the Newsletter.  You do not have to sign up for our Newsletter to use our website.

2.       If you choose to share our content with a friend, we may require you to provide us with information (including Personally Identifiable Information) such as your friend’s email address, your name, and your email address.  This information is necessary for us to send the content you requested to your friend and to notify you when it is sent.  We will never use you’re your friend's email address for any other purpose then to send the content you requested, unless otherwise disclosed to you at the time you request us to send the content.  You do not have to share any of our content with a friend to use our website.

3.       If you choose to participate in one of our promotions we may offer on our website from time to time, we may require you to provide us with information (including Personally Identifiable Information) such as your name and your email address. 

4.       If you sign up for one of your online products or services we may require you to provide us with information (including Personally Identifiable Information) such as name, email address, and billing information.

5.       If you contact us regarding a question or comment you have, we may collect your information (including Personally Identifiable Information) to respond to your questions or comments.

6.       Through the use of Cookies and Web Beacons. (Explained in detail below)

When using our online products we may collect information about you in the following ways:

  1. When creating or updating your member profile we may ask you to provide us with information (including Personally Identifiable Information) such as gender, age, ethnicity, date of birth, general health/lifestyle information, and community demographics.
  2. When creating or updating your account information we may require you to provide us with information (including Personally Identifiable Information) such as contact information (name, address, and phone number) and billing information.
  3. When interacting with the system or working with your nutritionist, we may ask you for Non-Personally Identifiable Information such as height, weight, diet/fitness history, and goals.
  4. When sending pictures or email to your Nutrax inbox from your camera phone or personal computer, we will collect the email address of the sending phone or computer.
  5. If you choose to participate in one of our promotions we may offer from time to time, we may require you to provide us with information (including Personally Identifiable Information) such as your name and your email address.
  6. If you contact us regarding a question or comment you have, we may collect your information (including Personally Identifiable Information) to respond to your questions or comments.
  7. Through the use of Cookies and Web Beacons. (Explained in detail below)

Cookies and Web Beacons

We use Cookies to collect anonymous, Non-Personally Identifiable Information about your use of our website, online products, emails, special promotions and/or Newsletters.  Cookies are small text files that are placed on a computer’s hard drive that allows us to identify the computers web browser, how often that computer visits our site and that computers activity once on our site.  Cookies allow us to better serve you by adding convenience features and personalizing your experience through custom content designed specifically for you.  Cookies help us understand the popularity of our content and give us the data we need to continually improve to our website and online products to enhance the user’s experience.

We may also use Web Beacons or GIF tags to collect anonymous, Non-Personally Identifiable Information about your use of our website, online products, emails, special promotions and/or Newsletters.  Unlike Cookies, Web Beacons are not placed on your computer.  Web Beacons are tiny image files within a webpage or email that when used in conjunction with Cookies help us track how many times a specific page has been viewed, and how many of our emails have been opened.  Similar to Cookies, Web Beacons supply us the data we need to provide better products and services.

We do not collect or disclose any of your Personally Identifiable Information through our use of Cookies or Web Beacons.

Children

We are dedicated to protecting the privacy of children. Our website and online products/services are not meant for or directed toward children under the age of 13.  We do not collect Personally Identifiable Information from anyone who we actually know is under the age of 13.

1.       We may use it to improve our website, adding convenience features and increasing the amount of content you enjoy the most.

We use the information we collect though our online products and services for the following:

  2. When you sign up for one of our products or services, we may use it to send you a welcoming email confirming your username and password, along with providing instruction on how to get started.
  3. If you opt-in upon signing up, we may use it to send you our newsletters, contact you regarding Nutrax products, services, information and new that may be of interest to you.  If you no longer want to receive these communications, we provide you a way to request that we stop sending them to you.
  4. We may use it for billing purpose
  5. We may use it to send you important announcements and updates about our website and/or online products and services, and about your billing account status. You will not be able to opt-out of these service announcements and updates as they contain important information relevant to your use of our website and/or our online products and services.
  6. If you choose to work with a nutritionist, we may use it to better personalize the information he/she provides you.
  7. If you choose to use the camera phone or email components we use it to allow you to choose what computers and phones can and cannot send information to your Nutrax inbox.
  8. If you contact us regarding a question or comment you have, we may it to respond to your questions or comments, and we may store your questions or comments for reference.

We may also use the information gathered on our Website and through our online products and services to identify trends in nutritional, dietary, or fitness behaviors to improve our online products and services.

 

Section 3: With whom do you disclose the information?

Except as described in this section or as specifically agreed to by you, we will not sell, rent or disclose any of your Personally Identifiable Information collected on our website or though our online products or services.

Law Enforcement

We may disclose your information (including Personally Identifiable Information) if we believe in good faith that we are required to do so to comply with valid legal requirements such as regulation, statute, law, subpoena, search warrant, court order, or other valid legal process.  In certain circumstances we may disclose your information (including Personally Identifiable Information) when we believe that said disclosure will help to identify, contact or bring legal action against someone who has violated our Terms & Conditions or help to protect the safety and/or security of our users, our website or the general public.

Third Parties

We may provide your Non-Personally Identifiable Information to third parties either by itself or combined with similar information of other users.  Third parties may include but are not limited to: potential or actual advertisers, providers of advertising services, providers of website tracking services, potential or actual commercial partners, sponsors, researchers and other similar parties.  Examples of the information we may provide includes but is not limited to: the demographics of our user base, the number of unique users who visit our website, the number of unique subscriber to our products/services, or other similar information.

Contractors
We may employ independent contractors, vendors and/or suppliers from time to time and on an ongoing basis.  For the purposes of this Privacy Policy we will refer to these individuals, organizations, or companies collectively as “Contractors".  These Contractors provide us with specific products and services.  These products and services may include but are not limited to: credit card processing, web hosting, application development, and other similar products and services.  While providing said product or service, these Contractors may from time to time have limited access to your information (including Personally Identifiable Information).  Their access to your information (including Personally Identifiable Information) is strictly limited to only that necessary for them to provide their product or service.  Contractors are prohibited from using or disclosing any of your information (including Personally Identifiable Information) for any purpose other than providing us with said product or service.  In addition, we require that all Contractors protect your information (including Personally Identifiable Information) consistent with this Privacy Policy.

 

Section 4: What choices do I have in relation to the collection, use, and distribution of my information?

We will only use your information (including Personally Identifiable Information) as described in this Privacy Policy.  If we are going to use it for any other purpose we will disclose this to you at the time we request such information.  We only collect the Personally Identifiable Information that you voluntarily submit to us.  You may choose not to submit any Personally Identifiable Information.  However, if you choose not to submit any Personally Identifiable Information, you will not be able to sign up for any of our online products and you may not be able to enjoy all of our non-subscription products, services, or promotions we may offer now or in the future.

If you no longer wish to receive our Newsletter, you may unsubscribe by going to the “Contact Us” page on our website, providing your first name, last name and the email address at which you receive the Newsletter, and clicking the “submit” button.  If you no long want us to contact you regarding Nutrax products, services, information and/or new, you may request that we cancel these communications by changing your account preferences.  If you wish to change your preferences with respect to communications and any other information you receive from us and you cannot find how to do so within the Account Help or our website FAQs, we encourage you to contact Customer Service at customerservice@nutraxcorp.com.

 

Section 5: How can I update or correct my information?

You can contact us at any time to update, correct, or delete your Personally Identifiable Information.  You can do so by updating your Member Profile and Account Information or by contacting our Privacy Manager at the contact information provided below.  Such updates, corrections, or deletions will not have any effect on the other information we maintain, or the information that we have provided to Third Parties consistent with this Privacy Policy prior to the requested update, correction, or deletion.


Please be aware that it is not technologically possible to update, correct, or delete each and every record of information that you have provided to us. Due to the need to back-up our systems to protect information against inadvertent loss, a copy of your Personally Identifiable Information may exist in a non-erasable form that will be difficult or impossible for us to locate. After receiving your request, we promise to take reasonable steps to update, correct, or delete all appropriate Personally Identifiable Information stored in our actively used databases and other readily searchable media.

 

Section 6: What security precautions do you take to protect against the loss, misuse, or alteration of my information while it is under your control?

We take pride in our security.  We want your Personally Identifiable Information to remain as secure as possible both during transmission and while under our control.  To help ensure the integrity and privacy of your Personally Identifiable Information we 1) use the industry standard for secure transmission when signing you up for one of our online products or services 2) we maintain a strict Corporate Security Policy.

For transmitting your Personally Identifiable Information over the Internet to our servers during the sign up process, we use Secured Socket Layer (SSL) encryption technology.  Once we have your Personally Identifiable Information we secure it on servers located in controlled, secure environments, protected from unauthorized access, use, or alteration.  Only employees who need your information to perform a specific task or function are granted access.  All Nutrax employees are required to abide by this Privacy Policy and our Corporate Security Policy.  Any employee who violates this Privacy Policy or our Corporate Security Standards is subject to disciplinary action, up to and including termination.

Although we make every effort to ensure that your Personally Identifiable Information is secure during data transmission and while on our systems, there is always some risk associated with transmitting information over the Internet.  There is also some risk that someone could find a way to breach our security systems.  While we take commercially reasonable steps to protect your information, due to these risks, we cannot guarantee the security and privacy of any information you transmit to us, and you do so at your own risk

All changes to this Privacy Policy will be posted here to ensure that you always know what information we collect, how we use it, and how, if at all, we disclose that information.  If at any point we decide to use Personally Identifiable Information in a manner significantly different from that stated at the time it was collected, we will notify you by email or otherwise, and you will have a choice as to whether or not we use your Personally Identifiable Information in this different manner.  We may also make non-significant changes to our Privacy Policy that generally will not affect our use of your Personally Identifiable Information. By continuing to use our website or any of our products, services, tools or resources provided online or over the phone, after a change has been posted, you agree to the revised terms of the Privacy Policy.  If you do not agree to the terms of this Privacy Policy, you should not use our website or any of our products, services, tools or resources provided online or over the phone.

 

Section 8: Does this Privacy Policy apply when I link to other websites?

This Privacy Policy applies to only our website.  Throughout our website there are links to other websites not owned or operated by Nutrax.  We will try to make it obvious, by opening another web browser, that you are leaving Nutrax and entering another site.  However, we are not responsible for the privacy practices of these other sites and we encourage you to read their Privacy Policies carefully before submitting any of your personal information on those sites.
